2. These terms

By using our website or placing an order, you agree to be bound by these terms. Please read them carefully before ordering. If you do not agree to them, you should not use our website to place an order.

3. Eligibility and account use

You must provide accurate information when creating an account, uploading photos, or placing an order. You are responsible for keeping your login details secure and for activity carried out using your account.

4. Orders and contract formation

When you place an order, you are making an offer to purchase goods from us. We will acknowledge receipt of your order by email. A binding contract is formed when we accept the order for fulfilment.

We may refuse or cancel an order before dispatch, for example if pricing is obviously incorrect, payment cannot be authorised, the order contains unlawful or infringing content, or the order cannot reasonably be fulfilled.

A minimum order value of GBP 3.00 applies. We are unable to accept orders below this amount.

5. Pricing and payment

All prices are shown in pounds sterling (GBP) and include any applicable taxes unless we say otherwise. Prices may change from time to time, but changes will not affect an order once accepted.

Payment is processed securely by Stripe or another payment provider we may use from time to time. We do not store your full card details on our own systems.

If an order is accepted or payment is taken at a zero, missing, or obviously incorrect price because of a technical issue, we may cancel the order and refund the amount paid to your original payment method.

6. Photos, uploaded content, and your responsibilities

You confirm that you own the rights to any images, text, or other content you upload, or that you have permission to use them for the purpose of placing the order.

You grant us a limited licence to store, process, edit where needed for production, and print your uploaded content solely for the purpose of providing the service you requested.

You must not upload any content that is unlawful, defamatory, abusive, obscene, discriminatory, or infringing of another person's intellectual property, privacy, or other rights.

We are not responsible for poor print quality caused by low resolution images, heavy compression, incorrect cropping choices, or colour differences between screens and printed output. Our minimum recommended resolution is 300 DPI at print size.

7. Production and delivery

We aim to dispatch orders promptly, usually within the timeframes shown on our website. Dispatch and delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by Royal Mail or other carriers, events outside our reasonable control, or inaccurate delivery information provided at checkout. Please see our Delivery Policy for more detail.

If the delivery address is not serviceable by our delivery partner, we may cancel the order and refund the amount paid to your original payment method.

8. Returns, reprints, and refunds

Our products are personalised goods and are generally exempt from the 14-day cancellation right under the Consumer Contracts Regulations 2013 once production has begun.

If your order arrives damaged, is materially defective, or is not as described, please contact us and we will review the issue. Where appropriate, we may offer a reprint, replacement, refund, or other reasonable remedy. Please see our Returns Policy for full details.

9. Intellectual property

All intellectual property rights in the MemSnaps website, branding, design, copy, and other site content belong to us or our licensors. You may not copy, reproduce, distribute, or exploit our site content except as permitted by law or with our written permission.

10. Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to that, and to the fullest extent permitted by law, our total liability to you in connection with any order or use of the site shall not exceed the amount you paid for the affected order. We are not liable for indirect, incidental, special, or consequential losses, including loss of profit, loss of business, or loss of opportunity.

11. Privacy and data protection

We handle personal data in accordance with our Privacy Policy, which explains how we collect, use, store, and protect personal information.

12. Changes to these terms

We may update these terms from time to time. The latest version will always be published on this page. Changes will not affect orders that have already been accepted.

13. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes relating to these terms, except where applicable consumer law allows you to bring a claim elsewhere.
